Catalyst MedTech Texting Campaign Terms and Service Agreement

Effective Date: 1/1/2025

1. Introduction By participating in Catalyst MedTech’s texting campaign (“Campaign”), you agree to the following Terms and Service (“Terms”). These Terms govern your use of and participation in the Campaign. If you do not agree to these Terms, do not participate in the Campaign.
2. Eligibility To participate in the Campaign, you must:

• Be at least 18 years old or have the legal capacity to enter into agreements in your jurisdiction.
• Be a resident of the United States of America.
• Own or have access to a mobile phone that is capable of receiving SMS or text messages.
• Provide accurate information when opting into the Campaign.

3. Opt-In Process Customers, clients, or contractors will opt in verbally through a phone call or face-to-face discussion. The staff will obtain consent by informing them that by submitting their phone number, they are opting in to receive recurring messages from Catalyst MedTech.
4. Opt-Out Process Customers, clients, or contractors will opt out verbally through a phone call or face-to-face discussion.
5. Message Frequency and Content

• Frequency of messages: You may receive 1 message per week/month as part of the Campaign.
• Message content: The messages may include promotional offers, discounts, reminders, and other content related to the Campaign.

6. Costs and Fees Message and data rates may apply to the text messages you receive as part of the Campaign. You are responsible for any costs or charges from your wireless service provider associated with receiving these messages.
7. Privacy and Data Collection By participating in the Campaign, you consent to the collection, use, and sharing of your personal information as outlined in our Privacy Policy. This may include your phone number and any other information you provide through the Campaign.
8. Limitations of Liability To the fullest extent permitted by law, Catalyst MedTech is not responsible for any damages, losses, or costs resulting from participation in the Campaign, including technical issues, delayed or undelivered messages, or any other issues beyond our control.
9. Changes to the Terms Catalyst MedTech reserves the right to modify these Terms at any time, with or without notice. Any changes will be effective immediately upon posting the updated Terms. Your continued participation in the Campaign after any changes signifies your acceptance of the new Terms.
10. Termination of Participation You may terminate your participation in the Campaign at any time by following the opt-out instructions. Catalyst MedTech reserves the right to suspend or terminate your participation if we believe you have violated these Terms or are engaged in fraudulent activity.
11. Governing Law These Terms and any disputes arising from the Campaign will be governed by and construed in accordance with the laws of the United States of America.
